This work by Émérigon (1716-1784) was considered at the time 'un oracle presque toujours sûr en matière d'assurance et cité devant les tribuneaux comme une autorité qui fait pour ainsi dire loi' (Dictionnaire de Biographie Française XII, 1241) Deals not only with the subject mentioned in the title, but covers the whole of maritime law. (i.e. chapter 6: du navire; chapter xii: des risques maritimes; vol. 2, chapter iii: Du change maritime etc.) 'Le Traité des assurances n'est pas borné à la seule matière qu'indique son titre. Il embrasse la presque totalité du droit maritime, et ne saurait être trop recommandé à ceux qui s'occupent de cette importante partie de la législation' (Camus).The author acquired during his long career an immense knowledge about the subjects concerned here, and in fact supplied much very important material to Valin for his important work on the ordinance of 1681.'The author of this work, an advocate in the parliament of Aix and a councillor in the admiralty court of Marseilles, died in 1784 ... He had by long practice and study acquired a very extensive and profound knowledge of maritime and commercial law. This treatise is of the highest authority. It is said by Lord Tenterden, in the preface to his work on maritime law, to be "peculiarly valuable for its extent of learned research, and the numerous and apt citations of the texts of the civil law and of the marine ordinances, the opinions of former writers, and the adjudications of the courts of justice of his own country, which are to be found in every part of it' (McCulloch). - 95 leaves (including the front blank and final blank) of volume one with a stain in the outer margin. Contemporary half marbled calf, marbled boards, extra, raised bands with gilt lettering, spine somewhat discoloured. Stencilled publication of his lectures on maritime law. These were never published as a printed book. The volume deals with naval personnel, maritime transporation, accidents at sea, assistance and aiding at sea, contracts and insurance, various legal requirements and responsabilities and many other interesting subjets relative to the subject.

In the preface the British people are praised for the defense of their freedom as an example for the Dutch. It forms the overture to the legal and political considerations and recommendations of certain Frisian cities to the states of Holland and Friesland on the legitimacy of military protection of Dutch merchant ships (the right of unlimited convoy), the consequences for the relationship with sea-powers France and Britain and notably the risk of a military conflict with the British over property of the VOC and in the Far East.

Contemporary calf, spine with raised bands, red label with gilt lettering, rebacked, somewhat rubbed and worn, joints cracking and weak but still holding. Ter Meulen & Diermanse, Ecrits sur Grotius, 55; Pollard & Redgrave, STC, 22175. First edition. The famous refutation of Grotius' plea for open and free seas. Selden puts forth that the sea might in fact be controlled by a nation with the exclusion of others. Selden (1548-1654) was a famous English lawyer, and of great erudition. The work was composed around 1618 put not published for political reasons. After re-working the text it was finally published in 1635 on order of Charles I. Complete with the errata leaf. - Some very light browning, but a sound and crisp copy, with generous margins, contemporary handwritten notes on front paste-down, bookplate of Rev. Joshua Rowley on front paste-down, another bookplate on verso of title-page, library stamp on first leaf with a stamp "Duplicate for sale 1769".

Rare first edition of this long time standard handbook on maritime insurance, which won the prestigious Prix Français Genicot in 1938 and went quickly out of print. Because of the war it appeared not until 1947 in a greatly revised second edition and a third in 1964.
